Important Questions

  • What should I do if I have been charged with a crime in New Jersey, New York, or Pennsylvania?

If you have been charged with a crime, it is imperative that you contact a criminal defense lawyer immediately to discuss your case and get advice on the best course of action. The earlier you contact a criminal defense attorney, the better chance that attorney has in obtaining a favorable outcome.

  • How do I choose the right criminal defense attorney in New Jersey, New York, or Pennsylvania?

Look for experience, expertise in criminal law, and a successful track record. Schedule consultations to find an attorney who understands your case and is willing to communicate with you regarding the strengths, weaknesses, and potential outcomes of your case.

  • What types of cases does a criminal defense lawyer handle?

Criminal defense lawyers handle a wide range of cases, including but not limited to DUI/DWI, drug offenses, assault, theft, white-collar crimes, and more.

  • What are the potential penalties I could face if convicted of a crime in New Jersey, New York, or Pennsylvania?

Penalties vary based on the severity of the offense. For example, in New Jersey, if you are convicted of a 2nd or 1st degree felony, you face a presumption of incarceration.  New Jersey also has the No Early Release Act, so if you are convicted of one of the offenses under the Act, you would be subject to a mandatory parole ineligibility period of 85% of your sentence.  Your lawyer can explain the potential consequences with you and formulate a game plan aimed at minimizing those consequences.

  • How much does hiring a criminal defense lawyer in New Jersey, New York, or Pennsylvania cost?

Legal fees vary. When discussing your case with an attorney, it is essential to discuss that attorney’s hourly rate and retainer fee structure during your initial consultation. Some lawyers offer payment plans which may assist in being able to afford good representation.

  • Should I talk to the police without a lawyer present?

No. Too often people believe that they could talk their way out of a situation only to find themselves in more trouble.  If members of law enforcement seek to speak with you, it is advisable to contact your lawyer and discuss your rights before speaking with police.

  • Can a criminal defense lawyer help with getting charges dropped or reduced?

Yes, a skilled attorney can investigate the case, identify legal issues, and work to have charges dropped or reduced.

  • How long does the criminal defense process take in New Jersey, New York, or Pennsylvania?

The timeline varies depending on the complexity of the case. Your lawyer can provide an estimate based on the specific details of your situation.

  • What should I bring to the initial consultation with a criminal defense lawyer?

Bring any relevant documents, police reports, and a list of questions. Be prepared to discuss the details of your case openly.

  • Do I need a criminal defense lawyer for a minor offense?

Even for minor offenses, having legal representation is beneficial. A lawyer can help minimize the impact on your record and provide guidance.

  • What do I do if I have been served with a Temporary Restraining Order?

Contact an attorney who is experienced in handling Restraining Orders.  A Final Restraining Order is serious and could have a severe impact on your life, including parenting time, a pending divorce, your job, or your freedom and liberties.

  • Do I need an attorney if I am a victim of domestic violence?

An experienced attorney will be able to advise you of your rights as a domestic violence victim, pursue a Restraining Order on your behalf, and connect you with services to address the traumas associated with Domestic Violence.

  • As a victim of domestic violence, are lawyers expensive?

When meeting with a lawyer to discuss your domestic violence case, be sure to ask about ways that the lawyer can represent you at no cost to yourself.  There are certain agencies that a lawyer can work with for the purposes of obtaining representation at no cost to a victim of domestic violence.
