Matrimonial

Choosing to end a marriage is difficult, but the divorce process does not need to be. Oftentimes the divorce process is long, arduous, and expensive if not handled properly. When ending your marriage, you are not only ending the relationship, but you are laying the groundwork for the rest of your life. The findings of fact and law in the dissolution document will contain the custom-tailored law of your case, which is binding upon the parties. Custody, parenting decisions, child support, alimony, and equitable distribution are just a fraction of the major issues that must be resolved, either by the parties or the judge.

Child Custody

A decision regarding child custody is among the most difficult and important decisions a parent and judge can make.  If the wrong decision is made, the ramifications on the parents can be difficult, but the repercussions to the children often last a lifetime.  Oftentimes, a wrong custody decisions endangers the child’s educational, emotional, and physical wellbeing.

In New Jersey, there are two types of custody: legal custody and physical custody.  Legal custody is the right to have input or decision-making power in major life choices

Landlord Tenant

Landlord Tenant issues present a complex balancing of interests.  On one hand, as the cost of living rises while wages stagnate, housing insecurity is a significant fear for many Americans.  On the other hand, when a tenant refuses to pay rent, the property owner is without the ability to meet their own financial obligations, creating a vicious cycle of financial instability.

When seeking to evict a tenant, a landlord must first file a Complaint and seek a Judgment of Possession.  If obtained, the landlord must seek a Warrant of Removal, upon receipt of which, they may have you removed from the premises by a law enforcement officer.

Civil Rights

Throughout the history of America, individuals and groups have been fighting to define and redefine one simple sentence, “We hold these truths to be self-evident, that all men are created equal.”  This fight has taken on many forms, including race, religion, national origin, gender, orientation, expression, age, pregnancy, familial status, disability status, veteran status, and citizenship.

Federally, the Equal Pay Act of 1963, the Civil Rights Act of 1964 and 1968, the Age Discrimination in Employment Act of 1975, the Federal Fair Housing Act, and countless other Acts and Amendments have been passed to secure the rights of protected classes in America.

Personal Injury

Injuries happen, but oftentimes, these injuries are avoidable if the proper care and attention is paid by those with a duty to do so.  These injuries can result in devastating life-altering consequences for an individual and their loved ones, leaving the victim and their family to pick up the pieces and shoulder the burden.  Fortunately, New Jersey protects an injured party or their representative to recover damages to alleviate that burden.  The most common damages recovered in Personal Injury are compensatory damages, which include property damages, medical bills, past and future lost wages, emotional distress, pain and suffering, loss of consortium, and loss of enjoyment of life. In certain cases, New Jersey permits punitive damages, which are capped at $350,000, or five times the amount of any compensatory damages, whichever is greater.
